ACT
The PPSA is a big challenge the hire
industry must resolve. With the change
in government complete, the HRIA is
regrouping with a special task force to
push for changes to this Act. The HRIA
urges members to provide examples
of where they have run foul of the
Act. It may be the registration process,
it may be an enthusiastic liquidator
intent on taking what you believe you
own, it may be the additional costs
you are incurring to comply. With these
thoughts, examples, ideas the HRIA
can challenge the PPSA bureaucracy
with facts and figures and get the rules
changed to be fairer to owners of hire
equipment.
The last HRIA Best Practice Survey had
some questions on PPSA. Well over
half of HRIA members have taken no
action to comply with the PPSA. The
association warns, if this is you, your
equipment can be taken any time if
your client goes into liquidation. Of the
remaining members who have done
something, 16% have taken onboard
the Master Agreements.
The remaining members believe
they have taken the relevant advice
and it won’t happen to them. 5% of
respondents to the survey said they
have already had equipment seized by
the liquidator.
“The latest example of a forklift
being seized by the liquidator helps to
highlight how we are all exposed to
this Act,” Phil Newby, Chief Executive
Officer of the HRIA said.
“It was a longer term hire starting
before the Act but had been changed
over and upgraded along the way and
never registered. In essence the owner
paid the liquidator $4.5K to get his
$27K forklift back plus $4.5K legal fees
and $9K in lost hire revenue.”

bushfires that swept through
the Blue Mountains west
of Sydney in NSW, late last

bushfire survivor who lost her
home by granting a wish with

Concrete Care relocates to Melbourne City
General Manager, Rob Machin,
said the change of location is a
positive move for the business
