U nder the PPSA registration procedures adopted by many hire businesses, registrations protecting equipment were often made to stay in force for seven years. The PPSA came into effect in January 2012 and the seven year period for those early registrations ended in January 2019. James Oxenham, HRIA CEO said HRIA members should review their registrations and consider implementing procedures to monitor expiry of PPSA registrations. “It is possible other expiry dates apply depending on the way registrations were made. Members might also consider removing registrations when they no longer deal with a customer in a way that leads, or could lead, to the PPSA being applicable,” James said. The scope of the PPSA was greatly reduced on the 20th May 2017 following extensive lobbying by the Association. “Hire leases are no longer caught by the Personal Property Securities Act unless the hire extends for more than two years. But bear in mind when calculating the two years, you also count the period of options if either you or the customer have an option to extend the hire. The May 2017 changes are not applicable to hires entered into before that time,” James said. Another deadline to keep in mind is hires entered into soon after the changes to the Act (eg: on 21 May, 2017) will be approaching the two year threshold in 2019. “If there is a prospect of the hire exceeding the two years, you need to consider re-registering before it expires.” Meanwhile the HRIA is continuing to push for reform on the PPSA.
